By virtue of an Order of Sale No. CV2019 03 0944 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 6TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and State of Ohio:

PARCEL I:

And known as being the North 30 feet of the South 100 feet of Lot No. 61 in Wm. T. and Bessie V. Sawyers Springfield Lake Allotment as recorded in Plat Book 10, Page 32, Summit County Records of Plats.

PARCEL II AND IX:

And known as being the North 20 feet of Lot 61 and the South 20 feet of the North 30 feet of Lot No. 64 in Sawyers Third Springfield Lake Allotment, as recorded in Plat Book 10, Page 32 of Summit County Records of Plats.

PARCEL III:

And known as being the South 18 feet of the middle forty (40) feet of Lot No. 60 in the William T. and Bessie V. Sawyers Springfield Lake Allotment as recorded in Plat Book 10, Page 32 of Summit County Record of Plats.

PARCEL IV:

And known as being the South 40 feet of Lot No. 60 in Wm. T. and Bessie V. Sawyers Springfield Lake Allotment as recorded in Plat Book 10, Page 32 of Summit County Record of Plats.

PARCEL V:

And known as being in the North ten (10) feet of Lot Sixty-four (64) and the South twenty (20) feet of Lot Sixty-five (65) in William T. and Bessie V. Sawyers Springfield Lake Allotment, as recorded in Plat Book 10, Page 32 of Summit County Records of Plats, and being subject to all the restrictions, conditions and limitations of said allotment.

PARCEL VI:

And known as being the North thirty (30) feet of the South seventy (70) feet of Lot #61 in Sawyers Third Springfield Lake Allotment as recorded in Plat Book #10, Page 32 of Summit County Records.

PARCEL VII:

And known as being the South fifty (50) feet of the North eighty (80) feet of Lot #64 in the Sawyers Third Springfield Lake Allotment as recorded in Plat Book 310, Page 32, Summit County Records.

PARCEL VII:

And known as being the North 22 feet of the middle 40 feet of Lot 60 in William T. and Bessie V. Sawyers Springfield Lake Allotment as recorded in Plat Book 10, Page 29 of Summit County Records of Plats, also the right to use Lot No. 25 of said allotment as a means of getting to and from the part of said Lot No. 60 hereby conveyed from and to the Springfield Lake Road; but said Lot 25 shall be used by said Grantees, their heirs or assigns only in getting to and from said part of said Lot 60 as aforesaid and for no other purpose and also the right to pass over the land of said Grantors lying and being South of the public highway and being part of said Lot #60 as aforesaid and for no other purpose, and also the right to pass over the land of said Grantors lying and being South of the public highway and being part of lands conveyed to original Grantors William T. and Bessie Sawyers by William Ritzman, John Ritzman and others by deed dated July 31st, A.D. 1903 and recorded in Summit County Records in Volume 297 on Page 7 to and from the waters of Springfield Lake for the purpose of fishing, hunting, boating and bathing in common with other persons designated by these Grantors. The rights and privileges aforesaid are hereby granted to the Grantors to the Grantees their heirs and assigns, as and only as an appurtenance to the part of said Lot 60 hereby conveyed and are inseparable therefrom and cannot be exercised or enjoyed, except in connection with and as an appurtenance of the part of said Lot 60 hereby granted, but subject to all legal highways. All buildings shall be set back at least six feet from the lot used for ingress and egress. Grantees, their heirs and assigns shall not engage in the business of letting boats for heirs on Grantors land South of said highway. No intoxicating liquor shall be sold upon the premises nereby conveyed.

Property appraised at: Sixty Thousand Dollars ($60,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 20th day of December, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
