By virtue of an Order of Sale No. CV2024 08 3480to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

PARCEL 1:

Situated in the City of Akron, County of Summit and State of Ohio and known a being part of Tract No. Five (5), formerly Portage Township, now in the City of Akron, and more fully described as follows:

Being at an iron pipe in the Southwesterly line of Cuyahoga Street, which is North 35 deg. 55' 10" West along said street 332.74 feet from the intersection of said lines with the Northwesterly line of Mustill Street; thence South 59 deg. West, a distance of 118.32 feet to an iron pin; thence North 33 deg. 55' 10" West, a distance of 65.62 feet to an iron pin set in the center line of a twelve foot driveway; thence North 63 deg. 12' 50" East along center line of said driveway, a distance of 119 feet to an iron pin in the Southwesterly line of Cuyahoga Street; thence South 33 deg. 55' 10" East along said street line, a distance of 56.79 feet to a place of beginning and containing 0.17 acres of land, more or less, subject to all legal highways, as surveyed by Charles C. Viers, March 4th, 1948, be the same more or less, but subject to all legal highways.

Beginning at an iron pipe in the Southwesterly line of Cuyahoga Street which is North 33 deg. 55' 10" West along said street line three hundred eighty-nine and fifty-three hundredths (389.53) feet from the intersection of said line and with the Northwesterly line of Mustill Street; thence South 63 deg. 12' 50" West, ninety-six and twenty-eight hundredths (96.28) feet to an iron pipe at the true place of beginning for this parcel; thence South 63 deg. 12' 50" West along the center line of a twelve (12) foot driveway thirty-five and ninety-two hundredths (35.92) feet to an iron pipe; thence South 75 deg. 30' 50" West along said center line fifty-two and ninety-three hundredths (52.93) feet to an iron pipe; thence North 86 deg. 56' 10" West along said center line thirty-seven and eighty-hundredths (37.80) feet to a drill hole in the brick pavement; thence North 29 deg. 36' 10" West, sixty-seven and forty-eight hundredths (67.48) feet to an iron pipe; thence North 60 deg. 18' 20" East, one hundred seven and ten hundredths (107.10) feet to an iron pipe; thence South 33 deg. 55' 10" East, fifty and no hundredths (50.00) feet to an iron pipe; thence North 60 deg. 18' 20" East, five and fifty one hundredths (5.51) feet to an iron pipe and thence South 32 deg. 32' 40" East, fifty-three and ninety-two hundredths (53.92) feet to the place of beginning and containing as surveyed July 1942 by S. G. Swigart & Son, 0.2527 of an acre of land, be the same more or less, but subject to all legal highways.

Property appraised at: Forty-five Thousand Dollars ($45,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 9th day of May, 2025. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
